By accessing our websites, purchasing any product or program, or enrolling in any coaching service, you confirm that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree to these Terms, you must not use our services.
AFC Ageless Fit Coach provides online fitness coaching programs, digital products, and educational content designed for busy professionals aged 30–65. Services include, but are not limited to:
Abba Fitness provides in-person personal training and group fitness services in Houston, Texas.
You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.
Upon enrollment in a digital program, you will be granted access to our training platform (Trainerize) using credentials provided at registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not share account access with any other individual. Unauthorized sharing of account access may result in immediate termination without refund.
All content on our websites and within our programs — including but not limited to workout plans, nutrition guidance, video content, written materials, graphics, logos, and the AFC Five to Thrive™ framework — is the exclusive intellectual property of Coach Ramiro / AFC Ageless Fit Coach and is protected by applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial use only. You may not reproduce, distribute, create derivative works, publicly display, sell, or exploit any content without prior written permission.

All prices are listed in U.S. dollars. Payment is due at the time of purchase. We accept major credit cards and other payment methods as presented at checkout, processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the total amount of your order. All sales are subject to the Refund Policy outlined in Section 7 of these Terms.
Digital program access periods are as stated at the time of purchase. Unless otherwise specified, online programs provide access for the duration of the program plus thirty (30) days following program completion. The Company reserves the right to modify or discontinue any program with reasonable notice.
Results vary significantly from person to person. Any testimonials, before-and-after photos, or case studies shared on our platforms represent exceptional results and are not typical. Individual results will depend on numerous factors including but not limited to adherence to the program, starting fitness level, health conditions, nutrition, sleep, and consistency. The Company makes no guarantee of specific results.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Your continued use of our services following such notice constitutes your acceptance of the modified Terms.
We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, the Company, or third parties. Upon termination, your right to use our services will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
Coach agrees to provide Client with fitness coaching services as described in the program or package selected at the time of enrollment. Services may include structured workout programming, nutritional guidance, habit coaching, accountability check-ins, and access to digital program materials. The specific scope of services is defined by the program purchased.

By enrolling in any program, Client represents and warrants that they are in adequate physical health to participate in a fitness program. Client acknowledges that fitness training involves physical exertion that may result in physical injury. Client agrees to obtain clearance from a licensed physician prior to beginning the program if Client:
Client acknowledges that physical fitness activities, including but not limited to resistance training, cardiovascular exercise, flexibility work, and nutritional changes, carry inherent risks including physical injury, muscle soreness, fatigue, and in rare cases, more serious health events. Client voluntarily assumes all such risks and agrees that Coach and Company shall not be held liable for any injury, illness, or adverse health event arising from participation in any program or service.
IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN ANY PROGRAM OR SERVICE PROVIDED BY COACH RAMIRO, AFC AGELESS FIT COACH, AND/OR ABBA FITNESS, CLIENT HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE COACH RAMIRO, AFC AGELESS FIT COACH, ABBA FITNESS, THEIR OFFICERS, EMPLOYEES, AGENTS, AND SUCCESSORS FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY CLIENT, OR TO ANY PROPERTY BELONGING TO CLIENT, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, OR OTHERWISE, WHILE PARTICIPATING IN SUCH ACTIVITIES.
This release applies to all programs, services, and activities, whether online or in-person, and whether presently offered or offered in the future by the Company.
For online digital programs: Client may request a cancellation and refund within the guarantee period specified at the time of purchase (typically fourteen (14) days), subject to the Guarantee Policy in Section 4. After the guarantee period, all sales are final and no refunds will be issued for digital programs.
For monthly 1:1 coaching arrangements: Client must provide a minimum of thirty (30) days' written notice to cancel or discontinue services. Notice must be sent via email to [email protected]. Client will be responsible for payment through the end of the final thirty-day notice period. Failure to provide proper notice will result in a charge equal to one (1) month's coaching fee as a cancellation fee.
Individual training sessions must be cancelled with a minimum of twenty-four (24) hours' advance notice. Late cancellations (less than 24 hours) or no-shows will be charged at the full session rate. Monthly membership cancellations require thirty (30) days' written notice.
Live virtual coaching sessions may be rescheduled with a minimum of 24 hours' advance notice, subject to Coach availability. Sessions missed without adequate notice will be forfeited. The Company will make reasonable efforts to accommodate rescheduling requests but does not guarantee availability.
Coach agrees to maintain the confidentiality of all personal health information, fitness data, and personal disclosures shared by Client during the coaching relationship, except as required by law or with Client's express written consent. Client consents to Coach using anonymized progress data and, with separate written permission, before-and-after photos for marketing and testimonial purposes.
Client may voluntarily provide testimonials, before-and-after photos, or success stories for use in Company marketing materials. By submitting such materials, Client grants Company a perpetual, royalty-free, worldwide license to use, reproduce, publish, and distribute such materials in any media for marketing and promotional purposes. Client may revoke this consent at any time by contacting [email protected].
Client agrees not to publicly disparage, defame, or make false statements about Coach Ramiro, AFC Ageless Fit Coach, or Abba Fitness on any public platform, including social media, review sites, or other online forums. Legitimate complaints should be directed to [email protected] for resolution.
In the event of any dispute between Client and Company, the parties agree to first attempt resolution through good-faith negotiation. If resolution cannot be reached within thirty (30) days, the dispute shall be submitted to binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
This Agreement, together with the Terms of Service, Privacy Policy, and any program-specific documentation provided at enrollment, constitutes the entire agreement between Client and Company and supersedes all prior discussions, representations, or agreements.
We stand behind the quality and effectiveness of our programs. If you are not satisfied within the first fourteen (14) days of purchase, you may request a full refund — no questions asked.
AFC Ageless Fit Coach offers a 14-Day Money Back Guarantee on all online digital programs, including but not limited to the 6-Week AFC Method, the 7-Day Reset Blueprint, and the 28-Day Momentum Method. To be eligible for a refund under this guarantee:

Due to the personalized nature and significant time investment required by 1:1 coaching arrangements, refunds for high-ticket coaching programs are evaluated on a case-by-case basis. Client must have:
Refund requests for 1:1 coaching must be submitted within fourteen (14) days of the first coaching session. Refunds, if approved, will be prorated based on sessions completed.
Pre-paid session packages for in-person training are non-refundable once sessions have been used. Unused sessions from pre-paid packages may be refunded on a prorated basis within thirty (30) days of purchase if no sessions have been used and a written refund request has been submitted. Monthly memberships are non-refundable for the current billing period.
Client agrees to contact us directly at [email protected] before initiating any chargeback or dispute with their payment provider. Unauthorized chargebacks will be contested and may result in permanent account termination and reporting to credit agencies. We are committed to resolving any legitimate concerns promptly and fairly.
While we cannot guarantee specific results — as individual outcomes depend on effort, consistency, and personal factors outside our control — we are fully committed to your success. If at any point during your program you are experiencing difficulties, please contact your coach immediately. We will work with you to adjust your program, provide additional support, and ensure you have the best possible experience.
The information, programs, and services provided by AFC Ageless Fit Coach and Abba Fitness are for educational and informational purposes only and do not constitute medical advice, diagnosis, or treatment. Coach Ramiro is a certified fitness professional, not a licensed medical doctor, dietitian, or mental health professional. Nothing in our programs or communications should be construed as medical advice.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COACH RAMIRO, AFC AGELESS FIT COACH, ABBA FITNESS, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO CLIENT FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY CLIENT TO THE COMPANY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Coach Ramiro, AFC Ageless Fit Coach, Abba Fitness, and their officers, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
By providing your mobile phone number and opting into SMS communications, you expressly consent to receive text messages from AFC Ageless Fit Coach and/or Abba Fitness, including marketing messages, program updates, appointment reminders, and promotional offers. Message and data rates may apply.
All SMS communications are conducted in compliance with the Telephone Consumer Protection Act (TCPA). We will only contact you via SMS between the hours of 8:00 AM and 9:00 PM in your local time zone. You will not receive unsolicited commercial SMS messages without prior express written consent.
You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. You may also opt out by contacting us at [email protected]. After opting out, you will receive one final confirmation message and no further marketing SMS messages.
By providing your email address, you consent to receive email communications from us. You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link in any email or by contacting [email protected]. Transactional emails related to your program or account cannot be opted out of while your account is active.
We use GoHighLevel as our CRM and communication platform. Message frequency varies based on your program enrollment and activity. Your information will not be shared with third parties for their marketing purposes.
All digital programs are eligible for a full refund within fourteen (14) days of purchase. After the 14-day window, all sales are final. To request a refund, email [email protected] with your order details.
Refund requests for 1:1 coaching must be submitted within fourteen (14) days of the first coaching session. Approved refunds will be prorated. Setup fees, intake assessments, and planning time are non-refundable.
Live virtual group coaching add-ons are non-refundable once the billing period has begun. If a session is cancelled by the Company, a credit or rescheduled session will be provided.
If physical products are offered, they may be returned within thirty (30) days of delivery in unused, original condition for a full refund minus shipping costs. Client is responsible for return shipping fees.
Approved refunds will be processed within seven (7) to ten (10) business days. Refunds will be credited to the original payment method. Processing times may vary based on your financial institution.
